Terms of Use

Welcome to Appsium! These Terms of Use ("Terms") govern your access to and use of the mobile applications (the "Apps") and website (the "Site") developed or published by Appsium ("we," "us," or "our").

By downloading, installing, or using our Apps or accessing our Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Apps or Site.

1. Use of Our Apps and Services

Appsium grants you a personal, non-exclusive, non-transferable, revocable license to download, install, and use the Apps on a mobile device that you own or control, solely for your personal, non-commercial use, in accordance with these Terms.

You agree that you will not:

  • Copy, modify, decompile, reverse engineer, or attempt to extract the source code of the Apps.
  • Use the Apps in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms.
  • Interfere with or disrupt the integrity or performance of the Apps or the data contained therein.
  • Use our Apps to generate or submit content that is abusive, threatening, obscene, or defamatory.

2. Subscriptions and Payments

Some Appsium Apps offer features or content via auto-renewing subscription models or one-time in-app purchases.

  • Billing: Purchases and payments are processed and managed entirely through the Apple App Store. All payment transactions are subject to Apple’s terms and conditions.
  • Cancellation: You can manage or cancel your active subscriptions at any time through your Apple ID settings.
  • Refunds: Since payment transactions are processed by Apple, you must request refunds directly from Apple support.

3. Intellectual Property Rights

The Apps, Site, and all original content (excluding user-generated inputs), features, functionality, design assets, and logos are and will remain the exclusive property of Appsium and its licensors. Our brand names, logos, app icons, and graphics are protected by copyright, trademark, and other intellectual property laws.

4. AI Features and User-Generated Content

Certain Apps (e.g. Talemoon for children's stories, AuraPen for note transcription) use artificial intelligence to generate stories, text summaries, or action lists based on your inputs.

  • You retain ownership of the text prompts and voice inputs you submit to our Apps.
  • You understand that AI-generated output is provided "as is" and may occasionally contain inaccuracies. We do not guarantee the absolute accuracy, completeness, or reliability of AI-generated content.

5. Disclaimers

Our Apps and Site are provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Appsium, on its own behalf and on behalf of its licensors, expressly disclaims all warranties, whether express, implied, statutory, or otherwise.

Without limitation, we provide no warranty that the Apps will meet your requirements, achieve any intended results, operate without interruption, or be secure or error-free.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Appsium or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, or personal injury) arising out of or in any way related to the use of or inability to use the Apps.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey.
